Use of Land Readjustment Mehod as an Alternative to Road Project Expropriation

Özet

One of the prerequisites for the construction of roads is the public ownership of the projected road route. Today, expropriation is mainly used to open road project routes. However, it is known that the expropriation method brings various social impacts and cost negativities. Although a price is paid to landowners during expropriation, the practice results in dispossession. High expropriation costs also constitute a significant financial burden for the public authority. In the studies conducted for Türkiye, it has been observed that the expropriation cost of road projects constitutes approximately 10% of the total road investment. Therefore, it is evident that an alternative method approach is needed to solve the social and economic problems highlighted. Land Readjustment (LR) is one of the leading alternative methods to expropriation. LR is based on the principle of joint deductions from landowners in return for the increase in the value of immovable property. In planned areas, it is a method that aims to acquire urban public facility areas free of charge and allocate the remaining parcel area after the standard deduction to urban settlement or development areas. With the implementation of the LR method, dispossession is also significantly prevented. It is known that road projects cause a value increase in the surrounding area after they are realized. In line with all these reasons, the method we propose in our study aims to transfer the road project routes to public ownership with the help of the LR method. In this way, cost recovery will be achieved in return for the increase in value caused by the road project. Within the scope of the method proposal, it is also suggested that a strip plan of road along the project routes be created.
